Function
The Organisation of Chief Labour Commissioner (Central) (CLC(C) is entrusted with the following functions.

1.Prevention and settlement of industrial disputes through conciliation/mediation.
2.Enforcement of Labour Laws and Rules made there under in Central Sphere.
3.Quasi-Judicial functions
4.Verification of Trade Union membership
5.Miscellaneous Functions

 

1. Prevention And Settlement Of Industrial Disputes

The CIRM ensures harmonious industrial relations in the central sphere establishments through :
A) Intervention, mediation and conciliation in industrial disputes with a view to bring about settlements of disputes.
B) Implementation of settlements and awards
C) Interventions in situations of threatened strikes and lockouts with a view to avert them.

(i).The Code on Wages, 2019

(ii).The Industrial Relations Code, 2020

(iii).The Code on Social Security, 2020

(iv).The Occupational Safety, Health & Working Conditions Code, 2020

(v).The Child & Adolescent Labour (P&R) Act, 1986

(vi).The Railway Act, 1989 (Chapter XIV- Hours of Employment Regulations)

 

Functions of the CLC(C)’s Organisation mainly confines to the establishments falling within the Central Sphere

What constitutes Central Sphere ?

Central Sphere comprises establishments where the Central Government is the Appropriate Govt under the Codes / Act.

 

Major Central Sphere Establishments

a.Central Government Ministries & Departments 

b.Central Public Sector Undertakings

c.Railways (including Metro), Mines, Oilfields,  Major Ports,  Air Transport Services, Banking & Insurance Companies

d.Telecommunication/ Telecommunication Services  [BSNL, Airtel, Jio, BBNL, etc.]

e.Corporations/ Authorities established by a Central Act  [i.e. AAI, FCI, CWC, LIC, NABARD, RBI, EPFO, ESIC etc.]

f.Autonomous bodies owned or controlled by the Central Government  [i.e. AIIMS, IITs, IIMs, NITs, ICAR, ICMR, etc]

g.Establishments carried on by or under the authority of the Central Government. [ i.e. Indian Railways, Ordnance factories, etc.]

h.Establishments having branches in more than One State – only for Code on Social Security. [i.e. TCS, Infosys, ITC Hotel, etc.]

Key Principle- Jurisdiction is determined by the “Appropriate Government” under the Codes / Act, irrespective of whether establishment is public or private sector
